Article 1: Definitions

  • Cooling-Off Period: The period during which the consumer can exercise their right of withdrawal.
  • Consumer: An individual acting outside their trade or profession who enters into a distance agreement with the entrepreneur.
  • Day: A calendar day.
  • Long-Term Transaction: A distance agreement involving a series of products or services delivered over time.
  • Durable Medium: A tool that allows the consumer or entrepreneur to store information for future reference, enabling unchanged reproduction of stored data.
  • Right of Withdrawal: The consumer’s right to cancel the agreement within the cooling-off period.
  • Entrepreneur: The individual or company offering products or services at a distance.
  • Distance Agreement: An agreement made through a system of distance selling, utilizing various methods of remote communication.
  • Distance Communication: Any means that enables an agreement to be made without the consumer and entrepreneur being physically present together.

Article 3: Applicability

These terms apply to all offers made by the entrepreneur and any agreement reached through distance selling with the consumer. Before the agreement is finalized, the consumer will have access to the terms and conditions. If not immediately possible, the consumer will be informed about how to access these terms and, upon request, receive them free of charge.

If the agreement is made electronically, the consumer will receive the terms electronically in a way that can be stored and retrieved for future reference. In case of conflicting terms, the most favorable conditions for the consumer will apply.

Article 4: Offers

Offers with limited validity or special conditions will be clearly stated. Descriptions of products and services will be detailed enough for consumers to make informed decisions. Pricing will include taxes, delivery charges, and any additional costs. Offers will clearly outline consumer rights, obligations, and terms, including the right of withdrawal if applicable.

Article 5: The Agreement

An agreement is finalized when the consumer accepts the offer and meets the outlined conditions. If the consumer accepts electronically, the entrepreneur will confirm receipt immediately. The entrepreneur reserves the right to refuse or attach conditions to an offer if the consumer’s payment capacity or other relevant factors raise concerns.

Article 6: Right of Withdrawal

  • Product Delivery: Consumers may cancel their purchase within 14 days of receiving the product, provided it is returned in its original condition and packaging.
  • Service Delivery: Consumers may cancel service agreements within 14 days of the agreement. The entrepreneur must provide clear instructions on how to exercise this right.

Article 7: Withdrawal Costs

Consumers exercising their right of withdrawal are responsible for return shipping costs. Any payments made by the consumer will be refunded within 14 days of withdrawal or the return of the product.

Article 8: Exclusion of the Right of Withdrawal

The entrepreneur may exclude withdrawal rights for specific products or services, provided this is clearly stated before the agreement is finalized. Exclusions apply to custom-made products, perishable goods, or products that cannot be returned due to health, hygiene, or other restrictions.

Article 9: Pricing

Prices will remain unchanged during the validity of the offer, except for changes in VAT rates. However, prices may vary if they are subject to market fluctuations beyond the entrepreneur’s control, which will be clearly indicated.

Article 10: Conformity and Guarantees

The entrepreneur guarantees that products and services meet the agreement’s specifications, are fit for their intended purpose, and comply with applicable laws and regulations. Any additional guarantees provided do not affect the consumer’s legal rights.

Article 11: Delivery and Execution

Orders will be fulfilled with care, and delivery will occur within 30 days unless otherwise agreed. If delivery is delayed, the consumer will be informed within 30 days and may cancel the agreement without additional costs. Replacement products may be offered if the original product is unavailable.

Article 12: Length Transactions: Duration, Termination, and Extension

  • Termination: Consumers may terminate long-term agreements at any time, with a notice period of one month. Agreements entered for a definite period may not be automatically extended without clear terms.
  • Extension: Definite agreements involving regular deliveries may not be automatically renewed unless for a specific short-term period, such as newspaper subscriptions.

Article 13: Payments

Payment is due within 7 days after the start of the cooling-off period. The consumer is responsible for notifying the entrepreneur of any payment inaccuracies. If the consumer fails to meet payment obligations, the entrepreneur may charge reasonable costs.

Article 14: Complaints and Chargeback Policy

Complaints should be submitted in a timely manner and will be addressed within 14 days. If a complaint requires more time to resolve, the consumer will be informed of the expected timeline.

If you believe there is an issue with a payment or unauthorized transaction on your account, please contact us immediately to resolve the matter. We take every concern seriously and are committed to addressing disputes in a timely and fair manner.

However, initiating a chargeback with your payment provider without first contacting us to resolve the issue may result in the following:

  1. Account Suspension: Accounts found to be engaging in unwarranted chargebacks may be temporarily or permanently suspended from using our services.
  2. Investigation: We will conduct a thorough investigation into any chargeback claim. If the chargeback is determined to be fraudulent or not in compliance with our terms, we reserve the right to challenge the chargeback with the payment provider.
  3. Fees: In the event of a chargeback, you may be responsible for any fees incurred by us as a result of the dispute, including but not limited to administrative fees and legal expenses.

We encourage all customers to contact our support team prior to initiating a chargeback to allow us the opportunity to resolve any issues and ensure your satisfaction with our services.

Article 15: Disputes

Bulgarian law applies to all agreements between the entrepreneur and the consumer, as outlined in these terms.

Article 16: Additional Provisions

Any additional provisions or modifications to these terms will be documented and made available in a way that allows the consumer to store them for future reference.

Once your return is received and inspected, we will send you an email to notify you that we have received your returned item. We will also notify you of the approval or rejection of your refund.

If you are approved, then your refund will be processed, and a credit will automatically be applied to your credit card or original method of payment, within a certain amount of days.
